What Data Do We Process and for What Purposes?

We process personal data, meaning any information relating to an identified or identifiable natural person (Article 4(1) GDPR).

In the course of our business activities, we process in particular contact data of our customers and their employees, business partners, and other third parties. In addition, we process payment data and—where necessary—other information relating to personal and economic circumstances, insofar as this is required for the provision of our services.

In some cases, we process data that we have not received directly from you, but from customers or other third parties. We may also use publicly accessible sources, in particular directories, registers, and freely accessible information on the internet.

We also process the data that you provide to us when contacting us (e.g. via email, business card, inquiry, or telephone). This is done, for example, to initiate a business relationship, respond to your inquiry, or communicate with you in general. Data may also be stored and processed where legally required. Furthermore, we process personal data necessary for the conclusion and performance of a contract entered into with us.

Legal Basis for Data Processing

The legal basis for processing your personal data is in particular:

  • Article 6(1)(f) GDPR (legitimate interest, e.g. initiation of business relationships or responding to inquiries), and
  • Article 6(1)(b) GDPR (performance of a contract or pre-contractual measures).

Storage Period

The collected data is stored for as long as it is necessary to achieve the purpose for which it was collected. In addition, we store personal data due to statutory retention and documentation obligations under tax and commercial law (e.g. HGB, StGB, or AO), which may require longer storage periods.

Further storage takes place if you have given your consent or if another legitimate interest pursuant to Article 6(1)(f) GDPR exists. If multiple retention periods apply, the longest period shall prevail.

Recipients of the Data / Data Disclosure

Personal data collected in the context of contacting us is generally not disclosed to third parties unless:

  • this is required by law,
  • necessary to fulfill contractual obligations,
  • required due to legitimate interests of third parties, or
  • based on your consent.

Possible recipients include in particular:

  • processors commissioned by us,
  • public authorities and governmental bodies,
  • customers and business partners.

Data is transferred to countries outside the European Economic Area (EEA) only if an adequate level of data protection has been confirmed by the EU Commission, appropriate safeguards exist, the transfer is necessary for contract performance, or you have expressly consented.

For contract fulfillment, we involve affiliated companies of the MeJuvante Group that are subject to confidentiality obligations (the MeJuvante Group includes, among others, the subsidiary MeJuvante Consulting GmbH & Co. KG). We also use technical support services, IT maintenance, hosting services, and services for file and data carrier disposal. Contracts for data processing pursuant to Article 28 GDPR are concluded with all relevant service providers.

Location of Data Processing

Your personal data is processed in our internal systems, by commissioned processors, and in data centers located within the Federal Republic of Germany.

Data Security / Data Backup

We are obligated to carry out regular data backups where necessary. In addition, we implement technical and organizational measures in accordance with Article 32 GDPR to protect our systems against unauthorized access, loss, manipulation, or other attacks. These measures include protection against malware and physical security measures to safeguard our business premises.

Your Rights as a Data Subject

You have the right to obtain information about the personal data processed concerning you (Article 15 GDPR).

You also have—where legally applicable—the right to rectification, erasure, or restriction of processing (Articles 16–18 GDPR), the right to object to processing (Article 21 GDPR), and the right to data portability (Article 20 GDPR).

If processing is based on your consent, you may withdraw this consent at any time without giving reasons (Article 7(3) GDPR).

You also have the right to lodge a complaint with a supervisory authority (Article 77 GDPR). The competent authority is generally the authority at your place of habitual residence.
